Stagecoach “Tomorrow’s Local Legends” Bursary Terms & Conditions”

1 Definitions

“Bursary” means the award of up to £3,000 to be awarded to the successful club applying to us pursuant to the terms of this agreement

“Club” means the sports club to whom we are awarding the bursary, as referred to in your application form and any supporting documents.

“Entry Form” means the form on this website in which you provide details to support your application to receive a bursary from us

“We” , “Us” and “Our” means Stagecoach Cumbria & North Lancashire, Head Office, Broadacre House, 16-20 Lowther Street, Carlisle, CA3 8DA.

“You” and “Your” means the club receiving the bursary bound by these terms and conditions. 

2 These Terms 

By completing and submitting an entry form, you agree to be bound by these terms and conditions confirm that:

2.1 Any signatories are authorised by the club named in the entry form to enter into a legally-binding agreement on the club’s behalf

2.2 The information provided to us in the Entry Form and any supporting documents is true and complete in all material respects, as well as adopted or approved by your Club;

2.3 You understand that any offer of the grant of a bursary will be subject to these terms and conditions;

2.4 You have the power to accept the grant of the bursary on behalf of your club if your application is not successful and to repay it if the conditions of grant are not met.

3 Eligible Clubs

Only junior sports clubs (whose members are aged between 5 and 16 years) located in West Cumbria may apply for the grant of a Bursary. Our employees and members of their immediate families (as well as those of the the agencies or companies associated with the grant of any bursary are ineligible to apply for the grant of a bursary.

4 How To Apply

4.1 You can apply for a bursary to be awarded to your club from 17:00 on 4^th December 2019. 

4.2 Each club must provide full contact details to be eligible to receive the bursary, including email address and telephone numbers, and bank details.

4.3 Once your entry form and all supporting information has been successfully verified by Tangerine Communications, successful applicants will be notified and the amount of the bursary to be awarded will be confirmed on 6^th January 2020.

4.4 We accept no responsibility for late, incomplete, incorrectly submitted, corrupted or misdirected, entry forms or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise

4.5 It is the responsibility of any club which is the recipient of a bursary to ensure that we and Tangerine Communications can contact you at all reasonable times to enable you to receive a Bursary. 

5 Grant of a Bursary 

5.1 We will award a combined total of £3000 (made up of successful applications for a maximum of £500 per application) to eligible entrants (as per the terms of clause 3 above) for the sole purpose of purchasing sport equipment for your club as set out in their entry form.

5.2 Each successful club will receive a bursary acceptance letter via e-mail sent to the address details provided on its entry form, and we will pay the sum of the bursary awarded to that club (as per the terms of clause 5.1 above) via the bank details set out in their entry form. 

5.3 The award of a bursary to a club and the amount of bursary awarded is at our sole discretion and our decision in that regard will be final and we will not enter into any further correspondence in relation to our decision. 

5.4 Once awarded, the amount of any bursary cannot be increased, altered or amended. 

5.5 Any sports equipment purchased by your club using the bursary must prominently feature our brand assets, which will be provided to you on request.

5.6 You agree to keep all equipment whose purchase is funded by the bursary in good repair for a period of 12 months following its grant, and acknowledge that you are obliged to use your own financial resources to ensure that it is replaced or repaired as appropriate. 

5.7 You agree to publicly acknowledge our grant of a bursary as appropriate, and to acknowledge our support in any publicity which refers to its grant to the club.

5.8 We will not be liable for any failure to award a bursary to a club caused by the provision of incorrect or incomplete information, postal disputes or other events beyond our control relating to the award of a bursary.

5.9 We will not be responsible nor liable for any loss or damage incurred by you should you be unable to redeem your bursary money for whatever reason.

5.10 You understand that:

5.10.1 We can only award a bursary during the period referred to in clause 4 above;

5.10.2 We may demand repayment of all or part of a bursary in our absolute discretion if:

5.10.2.1 You fail to meet any of these terms and conditions, 

5.10.2.2 You provide incorrect information in an entry form, 

5.10.2.3 You provided information in an entry form which is significantly misleading or otherwise inaccurate;

5.10.2.4 Members or staff of your club act in a dishonest or negligent manner or otherwise directly or indirectly to our detriment after the award of a Bursary;

5.10.2.5 Your club, its staff or members are the subject of an investigation or formal enquiry by the Police, Charity Commission, HM Revenue & Customs or other equivalent regulatory body;

5.10.2.6 You receive similar or duplicate funding to the bursary from any other source; 

5.10.2.7 You become legally ineligible to receive the bursary;

5.10.3 We have the right to impose additional terms and conditions to the grant of a bursary if:

5.10.3.1 You are in breach of these terms and conditions; or

5.10.3.1.1 We determine that your staff or members act in a way that may have a detrimental impact on our reputation.

6 Limitation Of Liability

6.1  So far as is permitted by applicable law, We and Our associated companies and agents exclude responsibility and all liabilities arising from: 

6.1.1 Your application to receive a bursary,

6.1.2 Any postponement or cancellation of the grant of a bursary; 

6.1.3 Any changes to the award of the amount of the bursary;

6.1.4 Any use of the bursary by the relevant club

6.2  We and Our associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) by any Club in connection with the Grant or use of a Bursary, except save in relation to any liability which cannot be excluded by law (including personal injury, death and fraud).

7 General

7.1  All named staff set out in the entry form of any Club applying for a Bursary will, at Our request, participate in reasonable promotional activity (such as publicity and photography) surrounding the award of the Bursary free of charge, and they consent to the Our using their name and images in promotional material in relation thereto.

7.2 If for any reason the award of any Bursary may not be made as anticipated, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond Our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of the award of a Bursary, We may in Our sole discretion cancel, terminate, modify or suspend the grant of any Bursary, or invalidate any affected entries.

7.3 We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, this grant of any Bursary in accordance with these terms with or without prior notice due to reasons outside its control (including, without limitation, in the case of anticipated, suspected or actual fraud). 

7.4 The names of all Clubs to whom we award a Bursary may be obtained by writing to Stagecoach Cumbria & North Lancashire, Head Office, Broadacre House, 16-20 Lowther Street, Carlisle, CA3 8DA, for a period of up to two months after the expiry of the period set out in clause 4.1 above.

7.5 These terms and conditions are governed by English Law and any dispute relating to their terms, interpretation or performance shall be subject to the exclusive jurisdiction of the English Courts.

7.6 We and our associated companies and agents will use any personal data provide in an Entry Form for the sole purpose of conducting and administering the grant of a Bursary. You agree that We may disclose any such personal data to our contractors and agents to assist in awarding a Bursary or communicating with the staff or members of a relevant club.
